1. RELEASE AND WAIVER OF LIABILITY IN CONSIDERATION of being permitted to participate in any way in TMB Racing Team Activities (“Activity”), I, for myself, my personal representatives, assigns, heirs, and next of kin: ACKNOWLEDGE and represent that I understand the nature of Triathlon Activities and that I am qualified, in good health, and in proper physical condition to participate. I fully understand that these activities involve risks of serious bodily injury, including permanent disability, paralysis, and death.
2. ASSUMPTION OF RISK I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation. I further acknowledge that activities will be conducted over public roads and facilities where hazards are to be expected.
3. INDEMNIFICATION I hereby release, discharge, and covenant not to sue TMB Tri Team, their administrators, directors, agents, officers, members, volunteers, and sponsors from all liability, claims, or demands caused or alleged to be caused in whole or in part by the negligence of the "releasees." This agreement is governed by the laws of the State of New Jersey.
4. PHOTO & MEDIA RELEASE I grant TMB Racing permission to use photographs, video, or recordings of me taken during activities for promotional purposes on social media and the team website.
